Can Trump Limit Birthright Citizenship? Legal Experts Are Doubtful

Former President Donald Trump has announced a new executive order aimed at curbing ‘birth tourism’ in the United States, reigniting a controversial debate around birthright citizenship. Birthright citizenship, enshrined in the 14th Amendment of the U.S. Constitution, guarantees citizenship to anyone born on American soil, regardless of their parents’ immigration status. This constitutional provision has been a cornerstone of American nationality law, but Trump’s latest order seeks to challenge its practical application by targeting pregnant foreign nationals who travel to the U.S. to give birth and secure citizenship for their children.

The proposed order, however, faces significant skepticism from legal experts who argue that the president’s authority to unilaterally restrict birthright citizenship is limited. The 14th Amendment clearly states that all persons born in the United States are citizens, making it a constitutional right explicitly protected.

Legal scholars point out that any attempt to alter this foundational principle through executive action would encounter a steep legal battle, possibly requiring Supreme Court intervention.
