Hong Kong authorities have convicted Jimmy Lai, the prominent pro-democracy media magnate and vocal critic of Beijing, in a pivotal national security trial. The 78-year-old was found guilty by a panel of government-approved judges of colluding with foreign forces and publishing seditious materials, charges that carry a potential life sentence. Lai has consistently denied all accusations.

Lai was initially detained in August 2020 under the national security law imposed by Beijing in response to the 2019 anti-government protests. He has remained in custody for five years, predominantly in solitary confinement, with noticeable decline in his health and physical condition. Besides the national security charges, Lai has also been convicted on several lesser counts related to fraud and his involvement in the protests.

The trial, held without a jury, drew significant international attention as a gauge of Hong Kong’s independence of judiciary and press freedom since its 1997 handover to China. In an extensive 855-page written judgment, the presiding judge stated that Lai persistently solicited foreign assistance to destabilize the Chinese Communist Party, even after the national security law came into effect.

Defense lawyers conceded that Lai previously advocated for foreign sanctions but maintained he ceased such calls following the law’s enactment. Despite this, the court concluded that Lai’s determination to undermine Beijing remained unchanged, asserting that his ultimate goal was the downfall of China’s ruling party regardless of the consequences for Hong Kong and China’s people.

The verdict identified Lai as the architect behind the conspiracies, noting contradictions and inconsistencies in his testimonies. Notable attendees in court included Lai’s family and key figures from Hong Kong’s Roman Catholic community. Following the ruling, Lai was quietly escorted from the courtroom after acknowledging his family members.

The case also holds significance for diplomatic relations. Lai, a British national, has been a subject of concern for foreign governments, with leaders publicly supporting his release and challenging the legitimacy of the proceedings.

Sentencing has been deferred for a future date, with hearings beginning in January to consider possible penalties. The Apple Daily, the pro-democracy newspaper Lai founded, ceased operations in 2021 after authorities shut its operations and seized its assets.

Throughout the lengthy trial, prosecutors presented extensive evidence including numerous articles, social media messages, and testimony capturing Lai’s engagements with foreign officials during the height of protests in 2019. Lai himself testified for nearly two months, emphasizing that he refrained from seeking foreign sanctions after the national security law was enacted and invoking freedom of expression.

Concerns about Lai’s worsening health emerged during the proceedings, with his legal team reporting various ailments including heart complications and infections. His daughter shared that despite his resilient spirit, his physical condition was rapidly deteriorating.

The Hong Kong government maintained that Lai’s medical examinations showed no irregularities and defended the level of care provided. Officials labeled Lai’s actions as detrimental to national interests, while police characterized the conviction as justice served.

Internationally, the verdict drew sharp criticism from human rights organizations and foreign governments who viewed the trial as politically motivated and damaging to press freedom. Conversely, Hong Kong authorities rejected claims linking the outcome to restrictions on free expression.

Residents queued early outside the court on verdict day, reflecting public interest in the case’s developments. Former associates of Apple Daily expressed mixed feelings about the trial’s swift conclusion and the uncertainty that lies ahead as sentencing approaches.
