Retail Giant Costco Sues US Government for Tariff Refunds Amid Supreme Court Showdown

Retail behemoth Costco has initiated legal action against the United States government, seeking a complete reimbursement of import duties. This move comes as the Supreme Court prepares to rule on President Donald Trump’s authority to impose tariffs without congressional approval.

Costco’s lawsuit, filed with the federal trade court, challenges the legality of tariffs levied under what President Trump asserted were “emergency” powers, citing the International Emergency Economic Powers Act (IEEPA). Lower courts have already determined that the former president exceeded his authority by using emergency provisions to implement these tariffs. The contentious case has now advanced to the Supreme Court, prompting numerous corporations to safeguard their entitlement to refunds should the justices invalidate the tariffs.

Over the recent Thanksgiving holiday, Costco lodged its complaint, asserting that its operations have been negatively impacted by the tariffs. The company expressed apprehension regarding the recovery of its funds, even if the nation’s highest court upholds the prior rulings. Legal representatives for Costco emphasized that a “separate action is necessary,” as a refund is not guaranteed “in the absence of their own judgment and judicial relief.” Millenium TV has learned that while the world’s third-largest retailer did not specify the exact amount it seeks, US customs data indicates that importers, including Costco, have collectively paid approximately $90 billion in IEEPA-related tariffs through late September.

The lawsuit was brought before the US Court of International Trade in advance of a December 15, 2025, deadline, beyond which the company would face significant challenges in recouping any payments made to the government. The Court of International Trade was the first to declare Trump’s tariffs unlawful in May, a decision subsequently affirmed by the US Court of Appeals. During recent hearings, Supreme Court justices appeared to harbor skepticism regarding the president’s power to impose such levies without congressional consent.

Lawyers representing the Trump administration have argued in court that emergency powers grant the president the authority to implement global tariffs. The administration has cautioned that an unfavorable decision would restrict its ability to negotiate with other nations and could result in the Treasury Department losing billions already collected.
